Terms of Service
These terms govern your use of the CarryBuddies platform, whether you send parcels, carry them, or both.
1. Who we are and what this agreement covers
CarryBuddies is a brand and technology platform owned and operated by Driven Innovation Solutions Private Limited, a company incorporated in India under the Companies Act, 2013, bearing Corporate Identity Number U63112HR2026PTC147339 and GSTIN 06AAMCD8500B1Z0, having its registered office at H. No. 5318, Ward No. 3, Kesar Nagar, Jagadhri Court, Jagadhri, Yamunanagar, Haryana 135001, India.
In these Terms, “CarryBuddies”, “we”, “us” and “our” refer to Driven Innovation Solutions Private Limited. The platform connects individuals who wish to send parcels (“Senders”) with individuals who are already travelling between locations and are willing to carry those parcels (“Travellers”).
By creating an account, accessing the platform or completing any booking, you agree to these Terms. These Terms constitute a binding agreement between you and Driven Innovation Solutions Private Limited.
The contract for carriage of any parcel is formed directly between the Sender and the Traveller. Our role is limited to identity verification, matching, communication tools, payment escrow, tracking, evidence capture and dispute facilitation.
2. Eligibility and verification
To use CarryBuddies you must:
- Be at least 18 years old and legally capable of entering into a binding contract;
- Register using accurate personal information that matches your identity documents;
- Complete our verification process, which includes mobile number confirmation, email confirmation and submission of a valid government-issued photo identity document (Aadhaar, passport, driving licence or voter ID) together with a live selfie for matching;
- Where acting as a Traveller, additionally verify a bank account held in your own name for payouts.
We may refuse, suspend or revoke verification at our discretion, including where documents cannot be validated, where information is inconsistent, or where we reasonably suspect fraud or misuse. Accounts may not be shared, sold or transferred. You are responsible for all activity under your account and for keeping your credentials and one-time passwords confidential.
3. Sender and Traveller responsibilities
3.1 Senders
- Declare the contents, weight, dimensions and approximate value of every parcel accurately and completely;
- Ensure the parcel contains nothing on the Prohibited Items list and nothing whose possession, carriage or transfer is unlawful;
- Ensure you have the lawful right to send the items and that they are not stolen, counterfeit or subject to any restriction;
- Package items adequately for ordinary transit conditions;
- Be present, or ensure an authorised person is present, at the agreed pickup point and time;
- Provide accurate receiver details and ensure the receiver is available to accept the parcel and provide the delivery OTP.
3.2 Travellers
- Carry only parcels accepted through the platform, and never carry off-platform;
- Inspect the parcel contents at pickup before sealing, and refuse any parcel that does not match the Sender's declaration;
- Keep the parcel in your own personal possession for the entire journey and never transfer it to any third party;
- Not open, tamper with, use or alter the parcel or its contents after pickup;
- Complete the delivery within the agreed window and only to a person who provides the correct delivery OTP;
- Comply with all applicable laws and with the rules of any airline, railway, bus operator or other carrier you travel with. Carrying a parcel on a commercial carrier is done on your own responsibility and at your own risk.
4. Declaration of contents
Every booking requires the Sender to declare the contents of the parcel and to affirmatively confirm that it contains no prohibited items. This declaration is a binding representation to CarryBuddies and to the Traveller.
The Sender indemnifies CarryBuddies and the Traveller against all losses, penalties, claims, proceedings and reasonable legal costs arising from any inaccurate or incomplete declaration or from the carriage of unlawful items.
5. Handover, tracking and proof of delivery
- Pickup. The Sender provides a one-time password (OTP) to the Traveller, who must enter it in the app to mark the parcel collected, and who captures a photograph of the sealed parcel.
- Transit. Trip status updates are shared with the Sender and receiver. The Traveller must retain sole possession of the parcel throughout.
- Delivery. The receiver provides a separate OTP, which the Traveller enters, and a delivery photograph is captured.
OTP entries, photographs, timestamps and location data form the evidentiary record for a shipment. You consent to this capture and to our retention and use of that record for verification, safety, dispute resolution and legal-compliance purposes, as described in our Privacy Policy.
6. Payments, fees and escrow
- The Sender pays the agreed delivery fee to CarryBuddies at the time of booking. Funds are held in escrow with our regulated payment partner for the duration of the shipment.
- CarryBuddies deducts a platform service fee — currently 15% of the delivery fee — from the Traveller's share. Fees are stated before booking and may change on notice for future bookings.
- The Traveller's balance is released once delivery is verified through the delivery OTP, and is settled to their verified bank account, ordinarily within 24 hours.
- Where a dispute is raised before delivery confirmation, escrow is frozen until resolution under clause 10.
- Payments outside the platform are prohibited. Neither party may request or make cash or direct transfers in connection with a booking.
- Travellers are independent individuals responsible for their own tax obligations on amounts received. Applicable taxes may be added to Sender charges.
7. Parcel protection
Once available, baseline protection will be included with every shipment and additional tiers may be purchased at booking, as described on our Pricing page. Protection is a platform-administered remedy and is not a contract of insurance unless expressly stated to be underwritten by a licensed insurer.
Protection is capped at the declared value of the parcel, subject to the tier limit purchased, and does not apply to:
- Prohibited items or items whose carriage is unlawful;
- Parcels whose contents were misdeclared or under-declared;
- Cash, bullion, jewellery, negotiable instruments and other bearer valuables;
- Loss or damage arising from inadequate packaging by the Sender;
- Items for which no reasonable proof of value or ownership can be provided;
- Consequential, indirect or economic loss of any kind;
- Shipments where the OTP handover process was not completed as required.
8. Prohibited conduct
You must not:
- Send, offer to send, or carry any item on the Prohibited Items list;
- Provide false identity information or use another person's identity documents;
- Arrange or solicit deliveries outside the platform, or request payment outside the platform;
- Circumvent, disable or attempt to bypass the OTP, verification, tracking or payment mechanisms;
- Harass, threaten, discriminate against or endanger another user;
- Post false ratings, manipulate trust scores, or create multiple or duplicate accounts;
- Scrape, reverse engineer, overload or otherwise interfere with the platform or its security.
9. Limitation of liability
To the maximum extent permitted by applicable law:
- CarryBuddies is not liable for the acts, omissions, conduct, negligence or default of any Sender, Traveller or receiver;
- We do not verify, inspect or guarantee the contents, condition, legality, quality or value of any parcel;
- We do not guarantee that a Traveller will be available on any route, that a delivery will be completed within any estimated timeframe, or that the platform will be uninterrupted or error-free;
- Our aggregate liability to you in connection with any shipment is limited to the total fees you paid to CarryBuddies for that shipment, plus any protection amount properly payable under clause 7 once that cover is available;
- We are not liable for indirect, incidental, special, punitive or consequential loss, or for loss of profit, business, goodwill or data.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence or for fraud.
10. Disputes between users
Disputes concerning loss, damage, delay or non-delivery must be raised through the platform before delivery is confirmed, or within 48 hours of delivery where the issue could not reasonably have been identified at handover. Raising a dispute freezes the escrowed funds.
We will review the available evidence — declarations, OTP records, pickup and delivery photographs, trip logs and both parties' accounts — and issue a determination. Our determination governs how escrowed funds and any protection amount are applied. It does not limit either party's independent legal rights against the other.
11. Suspension and termination
We may suspend or terminate your account, with or without notice where circumstances require, if you breach these Terms, if we reasonably suspect fraud or unlawful activity, if verification cannot be maintained, or if your continued use presents a risk to other users. You may close your account at any time; obligations relating to completed or in-progress shipments, and clauses 4, 6, 7, 9, 10 and 12, survive termination.
12. Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Subject to any mandatory consumer-protection rights available to you under applicable law, the courts at Yamunanagar, Haryana shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or your use of the platform.
13. Changes to these Terms, and contact
We may update these Terms as the platform develops or as legal requirements change. Material changes will be notified in-app or by email before they take effect. Continued use after the effective date constitutes acceptance. The version in force at the time of a booking governs that booking.
